Unfortunately individuals with disabilities, especially neurological and emotional disabilities, often have a higher likelihood of being arrested and/or incarcerated. We believe that an individual should not be incarcerated or have their rights taken away on account of a disability. By using his knowledge and experience helping individuals with disabilities in both special education matters and matters with the Division Development Disabilities, Mr. Becker has been able to dismiss or reduce criminal charges for many disabled clients.
Many people facing criminal charges are often suffering from emotional and related problems. These people need help, not punishment. Unfortunately, many people with criminal charges falsely claim emotional problems to avoid liability. Using his knowledge of disabilities and disability law Mr. Becker has been successful in showing that his clients' disabilities, including their emotional problems, legitimately relate to the criminal action. Mr. Becker has learned that it’s not enough to suggest an individual has an emotional problem. An attorney needs to effectively show that their client has recognized their emotional problem and has found proper resources to address those problems. The attorney need to show that there is a likelihood that based on the new resources the accused will move in the right direction and will avoid further dangerous behavior. We have been successful in helping many of our clients access the proper services to address their disability and move their lives in the right direction. We found that proof of this improvement is vital to the success of many criminal cases.
Individuals with disabilities are also more likely to be improperly charged with criminal actions. Many people mistake an individual's symptoms of the disability as criminal action. In addition, individuals with disabilities are often more susceptible to grooming by a criminal co-conspirator. In such cases it is important that the criminal defense attorney not only be well-versed in criminal law, but also on who understanding how individuals’ disability affects their daily interactions. This allows the attorney to properly show the court how the defendant’s actions were either unintentional or otherwise mitigated.
We found that that when properly informed the judges and prosecutors in New Jersey and Pennsylvania are usually receptive to the needs of the disabled population. In some cases, we’ve been able to turn criminal charges into a positive result, as we have used the forum as an opportunity to obtain access to vital services for clients. We also been able to effectively use the expungement laws in order to remove past criminal charges from clients' records.
